TM TUNING TERMS & CONDITIONS
 
All terms and services expressed in this document apply to all transactions unless otherwise stated by TM Tuning or agreed to by both TM Tuning and the buyer. Any violation of these terms and services by the purchaser will render the transaction between buyer and TM Tuning null and void.
ORDER PLACEMENT


Buyers can place orders by speaking with a customer service representative via e-mail and/or telephone or directly ordering online using the secured shopping cart system.

TM Tuning will only accept payments via bank transfer, Western Union, Paypal, Visa or Mastercard. TM Tuning will provide the buyer as much confidentiality as possible when purchases are made using credit cards and any other such personal information including home address, name, etc. In the highly unlikely case that any action not limited to credit card fraud should arise, TM Tuning will not be held accountable. It is the responsibility of the credit card holder to apprise the appropriate authorities, companies, persons, etc. to resolve this matter and TM Tuning will assist as much as it possibly can.

TM Tuning is at liberty to exclude any information it feels the customer should not know.

TM Tuning reserves the right to cancel any unpaid orders at its discretion after a period of 2 weeks after order placement. It is incumbent on the person making the order to notify TM Tuning once TM Tuning has requested information to proceed with an order. Unless otherwise agreed to by both parties, any orders that have not resulted in payment after 2 weeks of order placement are considered cancelled.

SPECIAL ORDERS

Special order items are excluded from the right of return. At the time a customer confirms a special order he or she is obligated to purchase and pay for the item.
PAYMENT

Once payment is made, TM Tuning will promptly provide the buyer with a detailed invoice via e-mail. It is the customer’s sole responsibility to verify and agree to all information on the invoice. Should the customer not respond to said e-mail or note any errors on the attached invoice, TM Tuning will treat it as confirmation that the information on the invoice is accurate and apply the resultant Terms and Conditions accordingly.
Payment is due in full before the order ships.
QUALITY

TM Tuning provides only the highest quality OEM and aftermarket tuning products. Almost all products on the website and/or available to purchase by TM Tuning meet TUV standards.

All lighting products available for purchase meet German E-Code specifications per STVO regulations.

A licensed OEM painter using genuine OEM paint will perform any painting work. This is a service that TM Tuning provides its clients without benefiting from it. Any damages, scratches or other such abrasions that may occur during shipping to and from TM Tuning are not TM Tuning’s responsibility. The customer should be well aware that painting can delay orders as much as 2 weeks, if not more, depending on the volume of activity the OEM painters have.
PRICING

Every product price on the TM Tuning website is subject to change at any time and without notice. The reason for said price alteration can vary and TM Tuning will generally inform its customers of said reason.

If a customer reserves an item or product and the price changes after the customer has completed payment in full, the customer is charged the lower of the two prices. If the altered price is lower than the price at which the customer was previously quoted and charged, the customer will receive a discount and/or refund equivalent to the difference between the changed and unchanged price.

All prices on our website are net prices.

VAT (sales tax) applies to all purchases with shipping address within the European Union. The VAT charge is based on the current German sales tax rate of currently 16 percent. Starting in January 2007 the VAT charge will be 19 percent. The sales tax will be charged on all items as well as shipping and handling to shipping addresses within the European Union.

It is the sole responsibility of the consumer to know of the VAT’s inclusion. TM Tuning invoices will always clearly state the VAT charge in any order and/or invoice made for shipment to a nation in the European Union.
SHIPPING


Every item ordered is shipped per the buyer’s request. TM Tuning is no longer held responsible for the package under any condition once said package has entered the shipping company’s system.

Any loss, damage or delay incurred is the direct responsibility of the shipping company. Unless TM Tuning is personally delivering the package, it is not responsible for any action that occurs during the shipping process.

Standard Air packages are only partially insured. The customer has the option to include full insurance at his or her own cost.
All Air Plus packages are insured up to a value of EUR 500.00. The customer also has the option to include additional insurance and be charged accordingly.
All Express and Air Freight packages are fully insured.


SHIPPING TRANSIT TIMES

Upon receiving payment in full, TM Tuning will send the buyer a detailed invoice with an itemized list for the order via e-mail. Included in this e-mail is an estimated time of arrival. The ETA provided is estimated based on past experiences and averages given by the shipping companies.

The ETA’s given for Standard Air and Air Plus shipments are simply estimates and do not reflect any guarantee whatsoever of a deadline of any sort for the product to arrive at the buyer’s shipping address. Specific arrival dates can only be given if the shipping method is Express or Air Freight.

It is the sole responsibility of the purchaser to verify all correct information on the invoice. TM Tuning is not held responsible for any incorrect information provided by the buyer and of any subsequent outcome that should arise (e.g. product sent to wrong address).
CUSTOMS AND IMPORT FEES

TM Tuning is not responsible for any customs, duties, import fees, taxes or any additional charges charged to the receiver. Any of the aforementioned charges and other such charges not mentioned are the sole responsibility of the purchaser/receiver.

Customs charge is a fee that all domestic governments impose on imported goods. The amount of the fee varies on certain factors, including the importing country’s standard customs bill. TM Tuning bears no responsibility whatsoever of this charge and it is up to the customer to know that this fee will or can apply on any purchase made from the TM Tuning website to any country outside of the European Union.
All purchases made do not include customs fees and all invoices reflect this fact.

It is the customers/buyers responsibility to retrieve information about importing fees from his or her local customs service.
TRACKING INFORMATION

Standard Air and Air Plus shipping methods do not feature international tracking. The German package number can only be used for tracking within Germany. After the package leaves the country it will be handed over to a local shipping company, from that point on the German package number is no longer usable for tracking information.

In cases where the customer selects Express and/or Air Freight as his or her shipping method, TM Tuning provides the customer with a valid tracking number. Once the package leaves TM Tuning, the shipping department will provide this tracking number as well as any other pertinent information to the customer.
RETURNS


Any item that is returned must be returned within 2 weeks after receival. The returned product cannot be used, installed and/or show any sign of use. If the customer is returning an item that shows any sign of use per TM Tuning’s discretion, he or she may not receive a full price reimbursement.

Unless otherwise stated, TM Tuning will not refund the customer the original shipping cost for returns. If TM Tuning originally shipped the wrong product, TM Tuning will refund the original shipping cost and will also provide the correct product at no additional cost.

In the case that TM Tuning sent out the wrong part due to the customer not providing the correct information, TM Tuning is not held accountable for the return or shipping cost.

All returns shipped back to TM Tuning are done so using the method detailed by TM Tuning. Before returning items to TM Tuning the customer must request an RA-NUMBER and return instructions.

Special order items are excluded from the right of return in any case.

It is the sole responsibility of the customer to have the correct information regarding the return policies of special orders. Should he or she have any questions regarding said policies, he or she can ask a sales representative for details.

DAMAGE CLAIMS

If an item was received in damaged conditions the customer must contact TM Tuning immediately. He or she will receive detailed instructions on how to handle the damage claim with the shipping company.
LOST PACKAGES

In the case that a package is lost, it is the responsibility of the receiver to claim the loss to the shipping company. TM Tuning will assist the buyer as much as possible by providing as much information as it can. In some cases TM Tuning can handle the damage claim for the customer, but the responsibility for the lost package does not lie with TM Tuning.

Interactions between purchaser and shipping company do not involve TM Tuning. TM Tuning will facilitate and accommodate both parties as much as possible, but it cannot guarantee satisfaction to either party.

Once and if TM Tuning receives appropriate compensation from the shipping company for a lost package, TM Tuning will, unless otherwise stated, ship a replacement.
WARRANTIES

In the case that a warranty is required for a specific item, TM Tuning will investigate it. The customer is obligated to provide requested information such as photos of the item in question, or to return the item to TM Tuning at his/her own cost. TM Tuning will then forward the warranty case to the manufacturer of the item.

In some cases TM Tuning will provide the customer with information necessary to contact the manufacturer directly. All parts sold by TM Tuning contain the original warranty of the manufacturer unless otherwise stated.
LIABILITY

M Tuning is free of any liability regardless of nature or situation. Any and all European-specific parts sold on the TM Tuning website and any of its affiliates are sold for show or off-road use only.

All North American and outer European-based customers are responsible for knowing that many items sold on TM Tuning were never intended for installation on North American VWs and that any purchase of any European-only part is at the absolute and sole liability of the buyer.

TM Tuning will not offer any refund or return from customers that are unwilling or unable to install European parts. Any purchases made by customers are the sole responsibility of the customer to know whether or not he or she can install the part correctly or do so under professional guidance. TM Tuning’s sales staff will provide as much information as it possibly can to assist in the matter of installation without guarantees. Any part not produced by TM Tuning or installed by a non-certified VW/Audi mechanic or dealer is under the sole responsibility of the manufacturer or the new owner.

Customers must be aware of all laws and regulations that apply to their purchases in their specific country. It is the sole responsibility of the purchaser to know whether or not a product can be legally installed, applied, adhered or otherwise attached onto his or her automobile.

TM Tuning is legally absolved of any illegal activity or action undertaken by or with use of a TM Tuning product. It is the responsibility of the person using the product to know, understand and apply any laws or rules accordingly.
